您對我們服務的使用受本《使用條款》約束。本《使用條款》所稱「DanceBar APP服務」、「我們的服務」或「服務」，是指DanceBar APP所提供搜尋及學習舞蹈的個人化服務，包括所有特性與功能、推薦與評論、APP與使用者介面，以及與我們服務相關的所有內容與軟體。

These Terms of Use govern your use of our service. As used in these Terms of Use, "DanceBar APP service", "our service" or "the service" means the personalized service provided by DanceBar APP for discovering and self-learing DanceBar APP content, including all features and functionalities, recommendations and reviews, the APP, and user interfaces, as well as all content and software associated with our service.

 

1.會員資格Membership

1.1.您的DanceBar APP會員資格會一直延續直到終止為止。要使用 DanceBar APP服務，您必須連接至網路並擁有DanceBar APP相容裝置，且您必須向我們提供一種或多種「付款方式」。「付款方式」意指現行有效並經接受的付款方式，得隨時更新，且涵蓋第三方管道透過您的帳戶付款。除非您在收費日期前取消續訂，否則視為您授權我們按照您的付款方式向您收取下次收費週期的會費（請參閱下文的〈取消〉）。

Your DanceBar APP membership will continue until terminated. To use the DanceBar APP service you must have Internet access and a DanceBar APP ready device, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your billing date, you authorize us to charge the membership fee for the next billing cycle to your Payment Method (see "Cancellation" below).

1.2.我們得提供多種會員資格方案，部分會員資格方案可能具有不同的條件與限制，有關條件與限制的資訊會在您購買時或向您提供的其他通訊中揭露。

We may offer a number of membership plans, including memberships offered by third parties in conjunction with the provision of their own products and services. Some membership plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you.

2. 促銷優惠Promotional Offers

我們得不時提供特殊促銷優惠、方案或會員資格（「優惠」）。優惠資格由 DanceBar APP全權酌情決定，且若我們認定您不符資格，我們保留取消優惠及暫停您的帳戶之權利。

We may from time to time offer special promotional offers, plans or memberships (“Offers”). Offer eligibility is determined by DanceBar APP at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible.

3.收費與取消Billing and Cancellation

3.1.收費週期。DanceBar APP會員費及針對您使用服務可能產生的任何其他費用，例如稅金或可能的交易手續費，將會以「我的訂單」頁面載明的具體付款日，依照您的付款方式向您收取。收費週期的期限將取決於您註冊服務時所選之訂閱類型。在某些情況下，您的付款日可能會變動，例如，您的付款方式並未結算成功，您更換訂閱方案，或是您的付費會員資格啟用日期在某個月份沒有對應日期。於APP點選「設定」頁面上的「我的訂單」連結，查看下一次的付款日期。我們得透過不同方式向您的付款方式授權扣款，以預支會員資格或服務相關費用。

Billing Cycle. The membership fee for the DanceBar APP service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the "My order" page. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the service. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid membership began on a day not contained in a given month. Visit our APP and click on the "My order" on the "Setting" page to see your next payment date. We may authorize your Payment Method in anticipation of membership or service-related charges through various methods, including authorizing it for up to approximately one month of service as soon as you register.

3.2.付款方式。要使用DanceBar APP服務，您必須向我們提供一種或多種「付款方式」。若您的主要「付款方式」遭拒，或無法再供我們向您收取訂閱費用，則您授權我們透過與您帳戶關聯的任何「付款方式」收費。您仍須為任何未付金額負有繳付責任。若因過期、資金不足或其他原因導致付款失敗，且您未取消帳戶，則我們可暫停您對服務的使用，直到我們成功透過您有效的「付款方式」收費為止。針對某些付款方式，發行機構可能會向您收取特定費用，例如跨國交易手續費或其他與您付款方式有關的處理費用。當地稅額可能因您所使用的付款方式而有所不同。詳情請諮詢您的付款方式服務提供者。

Payment Methods. To use the DanceBar APP service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used.

3.4.取消。您可隨時取消您的DanceBar APP自動付費服務，而在當次收費週期結束前，您仍可繼續使用DanceBar APP服務。在相關適用法律許可之範圍內，付款不可退還，且對於未滿一個會員訂閱期的會員，我們不予退款或抵用。若要取消，請前往「設定」頁面關閉自動續約功能。如果您取消自動續約，則您的帳戶將於目前收費週期結束時自動關閉。

Cancellation. You can switch off your DanceBar APP Auto-Renew at any time, and you will continue to have access to the DanceBar APP service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods DanceBar APP content. To cancel, go to the "My order" page and switch-off Auto-Renew. If you switch-off Auto-Renew, your account will automatically close at the end of your current billing period.

3.5.變更價格與訂閱方案。我們可不定期地變更訂閱方案與服務價格；但任何價格或訂閱方案地變更須在通知您至少 30 天後方能生效。

Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.

 

4. DanceBar APP服務DanceBar APP Service

4.1.您必須至少年滿 18 歲或達到您所在省份、地區或國家的法定成年年齡，方可成為DanceBar APP服務的會員。未成年人須在成年人監督下使用本服務。

You must be at least 18 years of age, or the age of majority in your province, territory or country, to become a member of the DanceBar APP service. Minors may only use the service under the supervision of an adult.

4.2. DanceBar APP服務的任何內容僅供您個人使用，不可作為商業用途，也不得分享予您以外的人士。在您的DanceBar APP會員資格有效期間內，我們授予您有限、非專屬、不得轉讓的權利，以使用DanceBar APP服務。除上述事項外，我們不向您轉讓任何權利、所有權或利益。

The DanceBar APP service and any content viewed through the service are for your personal and non-commercial use only and may not be shared with others. During your DanceBar APP membership we grant you a limited, non-exclusive, non-transferable right to access the DanceBar APP service and view DanceBar APP content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.

4.4. DanceBar APP服務會定期更新。此外，我們亦將會持續針對本服務各方面進行測試，包括APP、使用者介面、促銷優惠及DanceBar APP內容的可得性。

The DanceBar APP service, including the content library, is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of DanceBar APP content. You can turn off tests participation at any time by visiting the "Account" page and changing the "Test participation" settings.

4.6.您同意根據所有適用法律、規則和規範或針對此服務或內容的其他使用限制規定使用DanceBar APP服務，包括與其相關的所有特性和功能。您同意不存檔、重製、散布、修改、展示、公開播放、出版、授權、製作衍生作品、出售或使用（除非本《使用條款》明確授權）DanceBar APP服務所含的內容和資訊或從 DanceBar APP服務或透過DanceBar APP取得的內容和資訊。您還同意不：規避、移除、更改、停用、降級或妨礙DanceBar APP服務的任何內容保護措施；使用任何網路機器人 (robot)、網路蜘蛛 (spider)、網路抓取 (scraper) 程式或其他自動化方式來取用 DanceBar APP服務；將透過DanceBar APP服務取得的任何軟體或其他產品或程式進行反解譯、進行還原工程或反組譯；插入任何程式碼或產品或以任何方式操控DanceBar APP服務的內容；或使用任何資料探勘、資料收集或資料擷取方法。此外，您同意不上傳、發佈、以電郵傳送或以其他方式發送或傳輸任何旨在干擾、破壞或限制與DanceBar APP服務相關的任何電腦軟體或硬體或電信設備功能的資料，包括任何軟體病毒或其他任何電腦程式碼、檔案或程式。如果您違反本《使用條款》或以非法或詐欺之途使用服務，則我們可終止或限制您使用我們的服務。

You agree to use the DanceBar APP service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the DanceBar APP service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the DanceBar APP service; use any robot, spider, scraper or other automated means to access the DanceBar APP service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the DanceBar APP service; insert any code or product or manipulate the content of the DanceBar APP service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the DanceBar APP service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

 

5. 密碼與帳戶存取Passwords and Account Access

建立DanceBar APP帳戶且付款方式已成功收費的會員（「帳戶所有人」）須為DanceBar APP帳戶中的所有活動負責。為保持對帳戶的控制並防止任何人存取帳戶（包括帳戶的觀賞記錄資訊），帳戶所有人應對為取得服務所使用之DanceBar APP相容裝置，掌握其控制權，不得將其帳戶的密碼或付款方式的詳細資料洩漏給任何人。對於您向我們提供的帳戶相關資訊，您有責任更新並保持其準確性。我們可能會終止或暫停您的帳戶，以便保護您、DanceBar APP或合作夥伴免受身份盜竊或其他詐欺活動的損害。

The member who created the DanceBar APP account and whose Payment Method is charged (the "Account Owner") is responsible for any activity that occurs through the DanceBar APP account. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the DanceBar APP ready devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, DanceBar APP or our partners from identity theft or other fraudulent activity.

 

6. 擔保與責任限制Warranties and Limitations on Liability

DanceBar APP服務是以「現狀」提供，不提供任何擔保並不附條件。特別是，我們的服務不可能不受到干擾或不會出現錯誤。您同意放棄對我們請求任何特殊、間接及衍生性的損害賠償。這些條款不限制您依據居住國家/地區強制法所享有的任何不可放棄的擔保或消費者權利。

The DanceBar APP service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.

 

7. 放棄集體訴訟Class Action Waiver

在適用法律允許的情況下，您與DanceBar APP同意，雙方僅得以個人身分對他方提起訴訟，而不得以任何主張為集體或代表訴訟的原告或集體訴訟成員之身分起訴。此外，在適用法律允許的情況下，除非您與DanceBar APP另有約定，否則法院不得將其他多於一人以上的原告之索賠（請求）與您的索賠（請求）合併審理 ，並且不得以其他方式審理任何形式的代表或集體訴訟。

WHERE PERMITTED UNDER THE APPLICABLE LAW, YOU AND DANCEBAR APP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, where permitted under the applicable law, unless both you and DanceBar APP agree otherwise, the court may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.

 

8. 雜項Miscellaneous

8.1.存續條款。如果本《使用條款》的任何規定被認定為無效、非法或不可執行，其餘規定的有效性、合法性或可執行性仍然完全有效。

Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

8.2.使用條款之變更與轉讓。DanceBar APP可不時修改本《使用條款》。我們可能隨時轉讓或移轉我們與您簽訂的協議，其中包括與我們相關的權利和義務，而且您同意就這類轉讓或移轉的相關事宜與我們合作。

Changes to Terms of Use and Assignment. DanceBar APP may, from time to time, change these Terms of Use. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.

8.3.電子通訊。我們只會以電子形式向您發送帳戶相關資訊（如付款授權、發票、密碼或付款方式更改、確認訊息、通知），例如透過電郵寄到您在註冊時所提供的電郵地址。

\Electronic Communications. We will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
